These Terms of Service ("Terms") govern access to and use of the Mumbai Resto platform ("Platform", "we", "us") by restaurant businesses and their authorized users ("you", "Customer").
By creating an account or using the Platform, you agree to these Terms.
1. About the service
Mumbai Resto provides software for restaurants to manage menus, online ordering, table bookings, payments integration, and related storefront tools. We may update features from time to time.

2. Eligibility and accounts
- You must be authorized to act on behalf of the restaurant you register.
- You are responsible for keeping login credentials secure and for activity under your account.
- Information you provide during registration must be accurate and kept up to date.
3. Subscription plans and billing
- Paid plans, trials, and pricing are described on our website and in your admin dashboard.
- Fees are billed in advance on a monthly or annual basis unless stated otherwise.
- Taxes may apply as per applicable Indian law.
- Failure to pay may result in suspension of paid features.
4. Acceptable use
You agree not to:
- Use the Platform for unlawful purposes or to process illegal transactions
- Upload content that infringes third-party rights or is misleading or harmful
- Attempt to bypass security, access other tenants' data, or abuse APIs
- Resell or sublicense the Platform except as expressly permitted
5. Your content and data
- You retain ownership of your restaurant content (menus, images, branding).
- You grant us a limited license to host, display, and process your content solely to operate the Platform.
- Customer order data for your restaurant is processed to provide the service to you.
6. Third-party services
The Platform may integrate with payment providers (e.g. Razorpay, Stripe), messaging, and hosting services. Their terms apply to those services. We are not responsible for third-party outages outside our reasonable control.
7. Availability and support
We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates, or force majeure events may cause downtime. Support channels and response times may vary by plan.
8. Disclaimer of warranties
The Platform is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement unless required otherwise by law.
9. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our aggregate liability arising from these Terms is limited to the fees paid by you to us in the twelve (12) months preceding the claim, unless a higher minimum is required by law.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising from your content, your restaurant's operations, misuse of the Platform, or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
11. Termination
- You may cancel your subscription as described in your dashboard or our Refund & Cancellation Policy.
- We may suspend or terminate access for breach of these Terms, non-payment, or legal/regulatory requirements.
- Upon termination, your right to use the Platform ends; provisions that by nature should survive will survive.
12. Changes to these Terms
We may update these Terms. We will post the revised version with a new "Last updated" date. Material changes may be notified via email or in-product notice. Continued use after changes constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction, subject to applicable consumer protection laws.

Restaurant customer-facing terms (orders, bookings, food refunds) are set by each restaurant on their own storefront and are separate from these Platform Terms.
